New York driver's license suspension for back taxes

For a lot of people, losing a driver's license means losing a way to get to work. So when a letter from the New York State Tax Department threatens your license, it gets your attention fast. Good. This is one of those letters with a deadline that matters.

I'm Solomon Grosinger, an Enrolled Agent in Brooklyn. I help people resolve New York State, New Jersey and IRS tax debts. Here is how the license suspension program works and what you can do.

Who can have a license suspended

If you have at least $10,000 in past-due tax debt personally assessed against you, New York law allows the Tax Department to recommend that DMV suspend your driver's license. "Past-due" means the debt is fixed and final, so you no longer have a right to challenge it in the normal way. Tax, penalties and interest all count toward the $10,000.

How the process works

  1. The 60-day notice. Before anything happens, the Tax Department sends a Notice of Proposed Driver's License Suspension. It gives you 60 days to resolve the debt.

  2. Referral to DMV. If you don't respond in time, the Tax Department tells DMV to suspend your license.

  3. The 15-day order. DMV sends an Order of Suspension or Revocation 15 days before the suspension date.

  4. Suspension. If the debt still isn't resolved by that date, DMV suspends the license.

Don't wait for step 3. The best time to act is as soon as the 60-day notice arrives.

Who may be exempt

The law lists some exemptions. You may qualify if you:

  • hold a commercial driver's license (CDL),

  • currently have your wages garnished by the Tax Department,

  • pay court-ordered child support or combined child and spousal support,

  • receive public assistance, or

  • receive Supplemental Security Income (SSI).

How to stop or lift a suspension

The Tax Department gives three paths:

  • Pay the debt in full. If the license was already suspended, the state tells DMV to remove the suspension.

  • Set up an installment payment agreement. If the license isn't suspended yet, the state won't request suspension as long as you keep the agreement. If it was already suspended, the state tells DMV to put the suspension on hold. Miss the terms and the suspension can come back. Under the law, missing payment arrangements more than once in 12 months can lead to an immediate referral.

  • Show you qualify for an exemption through the state's protest process.

There is also an undue economic hardship route. You file Form DTF-5.1 together with Form DTF-5, a statement of your finances. Be careful: filing those forms is not a protest. If you want to keep your protest rights, you also have to follow the protest procedure, within the deadline.

If your license is already suspended, DMV can't clear a tax suspension on its own. The Tax Department has to notify DMV after the debt is resolved. If you need to drive for work in the meantime, DMV has information about conditional and restricted licenses.

  2. Check whether you qualify for an exemption or a hardship claim.

  3. Look at the full picture, including warrants, other assessments and any IRS balance.

  4. Set up the payment agreement or other resolution that fits your budget, and make sure the suspension is stopped or lifted.

Common questions

How much do I have to owe for NYS to suspend my license? At least $10,000 in past-due tax, penalties and interest that was personally assessed against you and is fixed and final.

How long do I have after the notice? The Notice of Proposed Driver's License Suspension gives you 60 days. If nothing is resolved, DMV later sends a 15-day order before the suspension date.

Will a payment plan protect my license? Yes, as long as you keep it. A kept installment agreement stops a new suspension request and puts an existing suspension on hold.

Does a commercial license (CDL) count? No. A CDL is exempt from this program under the law. Other collection, like warrants and levies, can still happen.

Is filing the hardship form enough? Not by itself. The hardship forms aren't a protest. To keep your protest rights, you also need to follow the protest procedure on time.
